Terms & Conditions
1. Scope and contracting party
These terms apply to all contracts for the use of "Kassenübersicht" between Narrowcastingscherm, Gouddonk 4, 4824DG Breda ("we") and the customer ("you"). [Review: is this offer for businesses (B2B) only, or also for consumers? This affects right of withdrawal, jurisdiction, etc.]
2. Description of service
Kassenübersicht is a web-based software-as-a-service (SaaS) solution for digitally recording daily cash registers for market vendors. Your purchase grants a time-limited right to use (license) the service for a set number of registers - not a perpetual software license and not ownership of the software.
3. Formation of contract
The contract is formed once your order has been successfully paid through our payment provider Mollie. Once payment is received, your license is activated automatically and your own installation is set up; you receive a confirmation by email.
4. Prices and payment
The prices shown on the website at the time of order apply. The starter package includes 1 register for the chosen term; additional registers can be added at any time at the then-current annual price per register. Payment is made in advance via Mollie using the payment methods offered there.
5. Term, renewal, and cancellation
A license is valid for the term chosen at purchase (in years). [Review: does the license renew automatically, or does it require active renewal? Define this consistently between the system and this text.] Cancellation before the end of the term is not applicable, as this is a time-limited right of use; access ends automatically at the end of the term unless renewed.
6. Right of withdrawal
[Review: if consumers (not just businesses) can be customers, a legally compliant withdrawal notice is mandatory - this is not yet included here and must be added by a lawyer.]
7. Customer obligations
You are responsible for the accuracy of the data recorded in the app (in particular for tax purposes) and for keeping your login credentials secure. Legal compliance of your cash register records (e.g. GoBD, TSE requirements) remains your own responsibility - we provide the tool, not tax advice.
8. Availability
We aim to provide uninterrupted service but cannot guarantee it (e.g. during maintenance or outages at our hosting providers). [Review: define a concrete availability/SLA commitment, if desired.]
9. Liability
[This section must be drafted by a lawyer - in particular the limitation of liability for minor negligence, data loss, and lost profit, within the limits of applicable law.]
10. Data protection
Information about how we process your data can be found in our privacy policy.
11. Final provisions
German law applies. [Review: define the place of jurisdiction - statutory restrictions apply if consumers can be customers.]
